Mesa, Arizona, April 29, 2022 – Fusion Orthopedics, LLC (“Fusion”) (www.fusionorthopedics.com) is a medical device company established in 2014 and known for numerous innovative technologies in the foot and ankle orthopedic market. The disruptive nature of Fusion’s patented IntraLock Fixation System continues to infuriate its competitor Extremity Medical, LLC (“EM”). Fusion’s IntraLock is expertly reviewed, has issued patents from the USPTO, and has a plurality of pending patent applications.

After a cursory review of the lawsuit, it appears EM has undertaken a multi-year campaign to unduly stretch the scope of their patent, which attempts to box out Fusion Orthopedics’ IntraLock Fixation System. Fusion fiercely disputes the baseless singular claim set forth by EM as filed in the U.S. District Court of Arizona. The IntraLock Fixation System does not infringe the claimed EM IO Fix patent.

Fusion’s position is that EM is inequitably attempting to weaponize their patents against companies to gain a market advantage beyond their legal right. This litigation tactic employed by EM is bad for healthcare because it attempts to strangle medical device innovation that may improve patient surgical outcomes and reduce the cost of care.

As a matter of good public policy, Fusion Orthopedics is deeply committed to combating any such legal tactics by EM and others.
